Product liability concerns spurred by child seat recall

Floridians who purchase products are expecting them to work as they are supposed to and to be safe. However, there is occasionally a failure on the part of the manufacturer toward achieving that end. It is especially egregious if the product that ended up being declared dangerous and recalled was designed for children. Those who have had a child injured or killed because of a dangerous or poorly designed product might have the basis for a product liability case to be compensated.

A manufacturer of child car seats, Graco, has recalled more than 25,000 of the items due to the assessment that they might not adequately restrain a child in car accidents. The webbing in this car seat, the Graco My Ride 65, was deemed to have a problem in its strength, raising the risk of injury or death in a crash. Regarding the car seats, the National Highway Traffic Safety Administration stated that the harness webbing might be subject to breakage and the child will be left unrestrained in an accident. These seats were made on July 22, 2014.

This comes one day after there was a report stating that 20 percent of children who died in a fatal car accident were unrestrained or not restrained properly. The researchers, while not mentioning these car seats, assert that if children were better restrained, by just 10 percent, there would be 232 fewer fatalities involving children in crashes.

While it is essential that parents know how to properly restrain their children in a car seat, even if the child is in the seat as the manufacturer suggests, a flaw with the product can render any attempts at safely securing the child meaningless.

There are various concerns after child accidents, including whether there was a product issue that caused the injuries and fatalities to happen. Those who believe that their child has been hurt due to a faulty product like a car seat need to understand their rights. Discussing the matter with a personal injury lawyer who is experienced in sifting through the information, and investigating the product, is imperative to filing a case.
